Terms & Conditions

Please read these Terms and Conditions (“Terms”) carefully before using the LingoLuz mobile application (“App”) operated by LingoLuz (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using LingoLuz, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, do not use the App.

2. Account Registration

  • You must create an account to access most features of the App.
  • You may register using email/password or Google Sign-In.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate, current, and complete information during registration.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

3.1 Free and Paid Plans

LingoLuz offers a free tier with limited features and paid subscription plans (Basic, Premium, Pro, and Game Mode) with additional features.

3.2 Billing and Auto-Renewal

  • Paid subscriptions are billed on a monthly recurring basis through the Apple App Store or Google Play Store.
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
  • Payment is charged to your App Store or Play Store account at confirmation of purchase.

3.3 Cancellation

  • You may cancel your subscription at any time through your device’s App Store or Play Store settings.
  • Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
  • No refunds are provided for partial billing periods.

3.4 Price Changes

We reserve the right to change subscription pricing. You will be notified in advance of any price changes, and continued use after the change constitutes acceptance.

3.5 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies.

4. AI Conversation Feature

4.1 Usage

The AI conversation feature uses third-party artificial intelligence (Anthropic’s Claude) to assist with language learning. Message limits vary by subscription plan.

4.2 Limitations

  • AI responses are generated for educational purposes and may not always be accurate.
  • The AI is not a substitute for professional language instruction.
  • We do not guarantee the availability, accuracy, or completeness of AI-generated content.

4.3 Prohibited Use

You agree not to use the AI conversation feature to:

  • Generate harmful, abusive, or inappropriate content
  • Attempt to bypass message limits or system restrictions
  • Use the feature for purposes unrelated to language learning
  • Input personal information of third parties

5. Hearts System

  • The Hearts system limits gameplay activity based on your subscription plan.
  • Hearts replenish daily according to your plan tier.
  • Hearts are non-transferable and have no monetary value.
  • We reserve the right to modify the Hearts system at any time.

6. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App’s functionality
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated systems or bots to interact with the App
  • Impersonate another person or entity
  • Upload or transmit viruses or malicious code
  • Exploit bugs or glitches for unfair advantage on leaderboards

7. Leaderboards and Game Scores

  • Leaderboard rankings are based on game performance and are publicly visible to other users.
  • We reserve the right to remove scores or reset leaderboards if we detect cheating or manipulation.
  • Game scores are final and immutable once submitted.

8. Intellectual Property

  • All content in the App, including but not limited to text, graphics, logos, icons, images, audio, lessons, quizzes, and software, is the property of LingoLuz and is protected by copyright and intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial language learning purposes.
  • You may not copy, modify, distribute, sell, or lease any part of the App or its content.

9. User-Generated Content

  • Messages sent through the AI conversation feature and any user-created content remain associated with your account.
  • By using the App, you grant us the right to store and process your content as necessary to provide the service.
  • We do not claim ownership of your personal learning data.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

11. Disclaimers

  • The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We do not guarantee specific learning outcomes from using the App.
  • Language content is provided for educational purposes and may contain errors or regional variations.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • LingoLuz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability for any claim arising from the use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
  • This limitation applies regardless of the theory of liability (contract, tort, or otherwise).

13. Indemnification

You agree to indemnify and hold harmless LingoLuz, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the App or violation of these Terms.

14. Termination

  • We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.
  • Upon termination, your right to use the App ceases immediately.
  • Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Intellectual Property) will survive.
  • You may delete your account at any time through the Account Settings screen.

15. Modifications to the App

We reserve the right to modify, suspend, or discontinue any feature of the App at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LingoLuz operates, without regard to its conflict of law provisions.

18. Dispute Resolution

Any disputes arising from these Terms or the use of the App shall first be attempted to be resolved through informal negotiation. If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
